5. Subscription and Payment Terms

Clarity may offer both free and paid subscription plans. If you subscribe to a paid plan:

• You agree to pay all fees associated with your chosen plan
• Subscription fees are billed in advance on a recurring basis
• All fees are non-refundable unless required by law
• We reserve the right to change pricing with at least 30 days notice
• You may cancel your subscription at any time through your account settings

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Clarity, you consent to our collection and use of personal information as outlined in the Privacy Policy.

7. Intellectual Property Rights

9. Service Modifications and Termination

We reserve the right to modify or terminate the Service at any time, with or without notice. We may also terminate or suspend your account if you violate these Terms.

You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

Upon termination, your right to use the Service will immediately cease, and we may delete your account and data after a reasonable period.

Dormant and Unused Accounts

We reserve the right to delete accounts that remain unused or dormant for extended periods:

• Free Accounts: Accounts that have never been logged into, or have not been accessed for 30 days from the last login activity, may be deleted.
• Paid Accounts with Expired Subscriptions: Accounts with expired subscriptions that have not been accessed for 90 days from the last login activity may be deleted.
• Cancelled Paid Accounts: When you cancel a paid subscription, your account and all associated data will be deleted immediately upon the end of your current subscription period.

Inactivity is measured from the date of the last successful login session. For accounts that have been registered but never logged into, inactivity is measured from the date of registration.

If your account is deleted due to inactivity or cancellation, you may re-register, but we cannot guarantee recovery of any previously associated data.

10. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLARITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to indemnify, defend, and hold harmless Clarity and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Clarity operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through a notice on our website. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
